Terms and Conditions

These are the General Terms and Conditions of www.bodymindawareness.net, Stine Chen Consulting, with its registered office in Kæragervej 2, 1.th., 2720 Vanløse and registered with the Chamber of Commerce under number 43115030. By accessing or using www.bodymindawareness.net and the services mentioned on the website, you agree to be bound by these Terms.

Services

Body Mind Awareness provides coaching, courses, and services well-being to individuals and organisations. We reserve the right to refuse service to anyone for any reason at any time.

Registration and Payment

Registration for our services can be done by contacting us directly. Payment for our services is required upon registration for our coaching or courses. A different payment scheme may be agreed upon in case of longer-term assignments with organisations. Body Mind Awareness accepts payment with VISA-Dankort, VISA, VISA Electron, Mastercard, PayPal, MobilePay, Bank transfer. We reserve the right to change prices from day to day without prior consent.

Payment can be divided into installments by agreement. If payment is divided into installments, the first installment is paid upon booking. The payment deadline is stated on the invoice. In case of late payment, interest of 1% per month is added from the due date until payment is made. The invoice is subsequently sent by email. If the customer fails to pay an overdue invoice for services within 14 days after receiving a written demand for payment from Stine Chen, in addition to interest, has the right to: (i) cancel the sale of the services concerned by the delay, (ii) cancel the sale of services that have not yet been delivered to the customer, or demand prepayment for these, and/or (iii) enforce other remedies for breach of contract.

For prepaid packages/multiple sessions/coaching programs, regardless of whether this entails a discount or not, unused sessions cannot be refunded.

Right of Withdrawal

According to "The Consumer Contract Act § 18 para. 2, no. 13," the coaching sessions are covered by the right of withdrawal if purchased online. The right of withdrawal lasts for 14 days after the purchase and requires that the customer has not received the session. If multiple sessions/coupon cards are purchased, the right of withdrawal must be exercised within 14 days of the purchase, as the right to a refund for unused sessions otherwise expires. The right of withdrawal must be exercised in writing by email to stinechenconsulting@gmail.com before the expiry of 14 days from the online purchase.

Delivery of Sessions

For online bookings of coaching sessions via Zoom or physical attendance, an email with suggested times for the chosen session is sent. Once the session is scheduled, it is binding. If the customer does not appear physically or over Zoom within the first 15 minutes of the session, Stine Chen is not obligated to hold the session. The customer is responsible for timely attendance or for having a functioning Zoom or phone connection.

Customers can change their appointment up to 24 hours before their scheduled time. No refunds are given after the session has ended.

Personal Data

In order for you to enter into an agreement with us, we need the following information about you:

Name, Address, Phone number, Email address, Information about what you have purchased.

We process your personal data for the purpose of delivering the item to you and for handling inquiries regarding your purchase. The processing is done in accordance with the rules in our privacy policy for Body Mind Awareness. Here you can read more about how your information is processed, when it is deleted, and what rights you have as a registered user.

Body Mind Awareness does not disclose information such as name, address, phone number, and email to any other party without the customer's consent.

Body Mind Awareness reserves the right to use customer cases in anonymized form for use on the website, newsletters, marketing, etc. Use of the customer's case in non-anonymized form only occurs with the customer's prior consent.

Intellectual Property

The full ownership of all intellectual property rights arising in connection with Stine Chen's performance of services, including trademarks and copyrights, concepts, and materials for online courses, belongs to Stine Chen. The material may not be copied and disseminated and is solely for personal use. In the event of the customer's violation of this provision, Stine Chen reserves the right to claim damages, just as the customer is subject to a conventional penalty that constitutes the customer's original payment for the service.

Legal Disputes

The above terms and conditions are governed and subject to Danish law's general rules, including consumer protection legislation. Any disputes arising out of or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Copenhagen.

Limitation of Liability

Body Mind Awareness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services provided. In no event shall Body Mind Awareness’s total liability exceed the total amount paid by the participant for the services.

Changes to Terms

We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Website following the posting of any changes constitutes acceptance of those changes.
